General Terms and Conditions MaRou Coaching

Article 1 Definitions In these general terms and conditions, the following definitions apply:

Practice: MaRou Coaching met richting, provider of coaching, training and mentoring

Service Provider: MaRou Coaching met richting

Client: the natural person or legal entity entering into an agreement with the practice

Participant: the person participating in coaching, training or mentoring

Coaching: individual guidance focused on personal and/or professional development

Training: structured individual or group sessions focused on knowledge transfer and skills development

Mentoring: guidance in which experience, reflection and advice are central to supporting personal or professional growth
-
Agreement: any arrangement between the practice and the client regarding the provision of services
Article 2 Applicability These general terms and conditions apply to all quotes, assignments, programmes and agreements under which MaRou Coaching met richting provides services, unless expressly and explicitly deviated from in writing.
Article 3 Formation of the Agreement The agreement is formed at the moment the client or participant gives verbal, written or digital consent to the offer of coaching, training or mentoring.
For coaching and mentoring, an intake conversation may be part of the formation of the agreement.
Article 4 Nature and Scope of Services

Coaching is focused on awareness, self-insight, personal responsibility and development

Training is focused on learning, deepening or strengthening knowledge, skills and behaviour within an agreed period

Mentoring is based on sharing experience, reflection and support from a coaching and advisory role
The services are effort-based and do not guarantee specific results. Results depend on the commitment, reflection and choices of the participant.
Coaching, training and mentoring are not a substitute for medical, psychological or therapeutic treatment. When in doubt, the participant is advised to contact a qualified healthcare professional.
Article 5 Participant Responsibility The participant remains at all times personally responsible for:

Their own choices and decisions

Their actions and behaviour during and after the programme

Applying insights in practice
The practice cannot be held responsible for the consequences of decisions made by the participant.
Article 6 Cancellation and Rescheduling Individual coaching or mentoring sessions: Cancellation or rescheduling is free of charge up to 24 hours before the start. Cancellations within 24 hours will be charged at the full rate.
Trainings and group sessions: Cancellations up to 7 days before the start will be charged at 50% of the rate. Cancellations within 48 hours before the start will be charged at 100% of the rate.
MaRou Coaching met richting reserves the right to cancel or reschedule trainings in cases of force majeure or insufficient participants. In such cases, a suitable alternative will be offered or the amount paid will be refunded.
Article 7 Rates and Payment
All rates are agreed in advance and are exclusive of VAT, unless stated otherwise.
Invoices must be paid within 14 days of the invoice date.
In the event of late payment, the practice is entitled to charge statutory interest and reasonable collection costs.
Article 8 Confidentiality MaRou Coaching met richting treats all information shared during coaching, training and mentoring as confidential.
A duty of confidentiality applies to all services, unless:

There is a legal obligation

Explicit consent has been given by the participant

There is a situation in which the safety of the participant or others is at risk
Article 9 Liability
The practice is not liable for direct or indirect damages resulting from participation in coaching, training or mentoring.
The liability of MaRou Coaching met richting is in all cases limited to the amount paid out by the liability insurance.
Article 10 Intellectual Property
All materials, documents, methodologies and content provided during sessions or trainings remain the property of MaRou Coaching met richting.
These may not be copied, distributed or used commercially without prior written consent.
Article 11 Complaints Procedure
Complaints about the services must be submitted in writing within 14 days of the relevant contact moment.
The practice aims to respond substantively within 14 days and to reach a solution together.
Article 12 Privacy and Data
Protection MaRou Coaching met richting processes personal data in accordance with the General Data Protection Regulation (GDPR).
Personal data is used solely for the performance of the agreement and is not shared with third parties without consent.

Article 13 Applicable Law and Disputes
These general terms and conditions are governed exclusively by Dutch law.
Disputes are preferably resolved through mutual consultation. If this proves not possible, disputes will be submitted to the competent court in the district where the practice is established.
